Requirement for establishment of Pollution Checking Centre
  1. Furnishing of Application.
  2. Proof of Land/Work shop, hired or owned by the applicant and shall has to posses a parking area minimum for 5 Vehicles.
  3. The applicant shall have to furnish the qualification Certificate /Trade Certificate having ITI/Diploma/Degree in Mechanical/Automobile/Motor Mechanic Trade with one year experience.
  4. N O C from Local Authorities.
  5. The Applicant shall have to Purchase Pollution Checking Equipments from those Companies approved by the Ministry of Surface Transport/ARAI Pune.
  6. The applicant shall have to re-calibrate their pollution Checking equipments after entering into AMC on yearly basis.
  7. The applicant shall have to deposit Rs. 10000/- as security deposit, authorization fee of Rs 7000/- & Rs 3000/- Annually as renewal fee.
Pollution Checking Centres
    Rule 115 of Central Motor Vehicle rules govern every Motor vehicle other than Motor cycles of engine capacity not exceeding 70 cc, manufactured prior in the 1st day of March 1990 shall be maintained in such condition at shall be so driven so as to comply with the standards prescribed in the Motor vehicle rules 1989. Accordingly this department has authorized for establishing pollution checking centres in the state indicated as below.

Pollution Guidelines

Annexure-I

GOVERNMENT ORDER NO. 49-TR OF 1997 DATED: 03-09-1997

  1. The Authorized Pollution Checking Centre shall display banners/Hoardings prominently for public view. .
  2. The Authorized Pollution Checking Centre shall deploy the authorized pollution checking personal to undergo training by instrument manufacture and Motor Vehicles Department (PCD) at the time of initial appointment. They should also be given refresher course once every two years.
  3. The Authorized Pollution Checking personal shall have diploma in Auto/Mechanical Engineering or ITI in Motor Mech./Auto Engineering/Diesel Mech./Tractor Mech. with one year experience. The Authorized Pollution Centre shall take prior approval of the Motor Vehicles Department in respect of authorized pollution checking personal. They shall also submit to the Department the exact signatures of the authorized signatory duly attested.
  4. The Authorized Pollution Checking Centre shall have all the requisite Licenses and permissions from local and other authorities.
  5. The Authorized pollution Checking Centre shall have facilities for engine diagnosis and repair of calibration and repair fuel injection pump (F I P) and fuel injection so that the vehicles which do not conform to prescribed pollution standards can be rectified by Centre accordingly to ensure pollution under control In respect of such vehicles. However, workshops not having (F I P) calibration facilities shall contract with FIP manufacture authorized dealers for undertaking repair calibration facing of F. I. Pumps.
  6. The Authorized Pollution Checking Centre shall have the Smoke-meters of the make approved by Ministry of Surface Transport and shall subject to such Smoke-meter for inspection by the Motor Vehicles Department to ensure proper functioning.
  7. The Authorized Pollution Checking Centre shall enter into annual Maintenance Contract (AMC) With smoke-meter manufacture or it's authorized dealer so that it is regularly serviced and calibration of instrument is ensured and recorded in a register.
  8. Testing procedure in accordance with the smoke-meter on an operation manual shall be followed seriously while checking pollution level.
  9. The Authorized Pollution Checking Centre shall charge fee from the Motor Vehicle owners for checking and issue of pollution under control Certificate at the following rates:

bThree Wheelers (Petrol)@ Rs. 60/-
c Four Wheelers (Petrol) @ Rs. 80/-
d Diesel Vehicles @ Rs. 100/-
  1. The Authorized Pollution Checking Centre shall perform pollution checking of only those type of vehicles specified in the authorization letter. The Pollution Checking Centre shall issue the pollution under control Certificate as the sample prescribed duly signed by the Authorized signatory only for those vehicles which conform to the standards prescribed under rule 115 (2) of CMV Rule, 1989. The checking shall not issue such certificates to those vehicles that do not conform to the prescribed pollution lards. No pollution under control certificate should be issued on chassis number or temporary Registration number.
  2. No Pollution under control Certificate shall be issued without mentioning the date and time of checking and simultaneously enter in the prescribed register Engine number and Chassis number. of the vehicle checked shall also be recorded. The pollution under Control Certificate shall be signed only after pollution checking is done and its entry is made in the register.
  3. Extract of the register of the month and the monthly report should be submitted to pollution control division latest by 5th of each succeeding month in the prescribed format (Annexure II).
  4. If it is seen that during inspection or otherwise the smoke-meter does not conform to standards and calibration/Linear values, the inspecting staff of Motor Vehicles Department will suspend the pollution checking activities of pollution checking Centre till the instrument is rectified and certified by the authorized agent of instrument manufacturer with whom service contract has been signed. The TCC shall submit this certificate to the department for grant of approval for recommencement of pollution checking activities.
  5. The Authorized Pollution Checking Centre shall always remain open to permit inspection by inspecting staff of Motors Vehicles Department so as to ensure proper facilities to the customers.

  6. The Authorized Pollution Checking Centre shall render Rs.10,000(Rupees Ten Thousand only) as security deposit to the Motor Vehicles Department, Govt of J&K. The security deposit will liable to be forfeited if the pollution checking centre violates any of the terms and conditions of authorization. In addition to forfeiture the pollution checking centre shall also be liable to fine ranging from Rs.1000/- to Rs. 15000/-(Rupees One Thousand to Fifteen Thousand only) and/or cancellation of authorization.
  7. The Authorized Pollution Checking Centre shall render Rs. 5000/-as, fee for grant of authorization, and Rs. 2500/- for renewal of the same. The Authorization of Checking Centre would be valid for a period of one year i.e., from 1st. April to 31st. March.
  8. The authority of authorization/renewal and cancellation shall solely rest with Motor Vehicles Department, Govt. of J&K.
  9. Renewal and authorization shall be subject to terms and conditions prescribed thereof.
  10. The appellate authority for any legal dispute shall be Transport Commissioner, Government of J&K.
  11. The authorization call be suspended or cancelled by Motor Vehicles Department t Govt. of J&K, after hearing the accused or after making such enquiry as it deems just and proper. In case, the authorized pollution Checking Centre is found indulging in any bogus/unlawful activities, both Owner of the PCC and his concerned employee shall be liable for prosecution.
  12. The Authorized Pollution Checking Centers will agree to indemnify the Motor Vehicles Department, Govt. of J&K, against any claim, damage or loss what-so-ever by reasons of any breach of Authorized Pollution Checking Centre obligation.
  13. The workshop meets the conditions laid down in annexure-I (Eligibility Criteria) and shall continue to fulfill these conditions during the period of authorization by MVD.

  14. ANNEXURE-II

A workshop established by a vehicle manufacturer, or by its authorized dealer or a petrol pump dealer or any other qualified person having a workshop/Training Institute having sufficient arrangements may be. authorized to set up a Pollution Checking Centre. However, this shall not be applicable to the Public Sector Undertaking, Govt. Bodies and Defense Unit having more than 50 vehicles and workshop facilities which seek authorization for their own vehicles.

The premises where workshop is housed should either be owned by the applicant or taken on lease by him. The premises should have minimum covered workshop area, two boys for repair of vehicles and an open parking area for 5 vehicles.

The workshop shall have the following Equipment/Machinery.

  1. Applicable For Diesel Driven Vehicles.
    1. Smoke meter of the type approved by Minister of Surface Transport, Govt. of India.
    2. Fuel injection pump phasing and calibration machine of the workshop shall have contract with pump manufacturers/ authorized dealer for phasing and calibration of the pump.
    3. Injection Nozzle Tester.
    4. Tachometer.
    5. Feler Gauge.
    6. Compression Gauge
  2. Application for petrol driven vehicle.
    1. Spark plug cleaner and tester
    2. Microprocessor infra-red exhaust gas analyzer

At least one of the members of the staff employed by the PCC, which are proposed to be authorized as Pollution Checking Personals shall possess the minimum qualification as prescribed in Para 3 of Annexure No. I to Order No. 49-TR of 1997 dated 03-09-1997.

Note:
  1. The facility recommended in Para 5 for repair and calibration of Diesel Fuel Injection Pump is not applicable for pollution checking centers authorized for petrol driven vehicle.
  2. No equipment recommended except spark plug and cleaner and tester required by Pollution Checking Centre authorized for testing petrol driven Scooter, Motor Cycle.
